The American Rescue Plan Act of 2021 (“Act”) established a third round of stimulus payment. Eligible individuals will receive a $1,400 direct payment from the treasury department as a result.
The Act specifically excludes “recovery rebates made under section 6428 of the Internal Revenue Code of 1986.”
The language is not as crystal clear as we would like, but based on the information we have gathered from attorneys and trustees around the county, all Chapter 7 trustees are uniform in their approach to this third round of stimulus payments:
They will not take the third stimulus payments from bankruptcy debtors.
